Mack Laing homes subject to Trust Law

The Mack Laing Heritage Society has received the opinion of a retired lawyer, William Pearce QC, regarding the obligation of the Town of Comox in relation to the bequest it accepted from Hamilton Mack Laing, and the agreed upon disposition of his home and property in perpetuity. Heritage BC has also weighed in this week with an offer to assist the Town of Comox with the restoration of Baybrook as a natural history museum that would recognize the historical and environmental importance of Mack Laing. William Pearce suggests that since Mack Laing’s final home, Shakesides, may not be easily restored, the accumulated trust funds could be applied to Baybrook to fulfill the terms of the original bequest.

As recommended by Mr Pearce, the MLHS has forwarded his opinion to the office of the Attorney General of BC, with all relevant documents. Mr Pearce states that demolition of the homes could render the Town and/or elected officials in breach of trust and liable for all damage.
